Welcome to SageMirrorPort ("we," "us," or "our"). The following Terms & Conditions ("Terms") apply to your use of our yacht charter services, as well as the website found at sagemirrorport.sbs, which are operated by SageMirrorPort.
Your agreement to these Terms is signified by your booking of a charter or use of our Service. If you do not agree with any section of these Terms, you must refrain from using the Service.
2. Service Overview
The services offered by SageMirrorPort include a variety of yacht charter options, such as:
- Yacht rentals for a day
- Cruises at dusk
- Retreats for businesses
- Exclusive gatherings
- Extended yacht charters
Service availability is contingent on conditions such as the weather. We hold the right to adjust or cease service offerings at our discretion.
3. Booking and Reservations
3.1 Booking Process
To secure a charter, you are required to:
- Have a minimum age of 18 years
- Provide truthful and complete details
- Make a deposit payment as detailed in the booking confirmation
- Accept these Terms & Conditions
3.2 Confirmation
A booking is deemed confirmed only after we receive the necessary payment and provide you with a written acknowledgment. We retain the right to decline service to any person for any reason.
3.3 Availability
Charter availability is dependent on both the availability of the yacht and agreeable weather conditions. We endeavor to honor your preferred dates and times when feasible.
4. Payment Terms
4.1 Pricing
All listed prices are denominated in £ and include any applicable taxes unless indicated otherwise. Prices are subject to modification without prior notice.
4.2 Payment Schedule
- Deposit: A payment equating to 50% of the full charter cost, required at the time of booking
- Balance: To be paid 48 hours before the charter's scheduled start
- Additional expenses (if applicable): Payable upon completion of the charter
4.3 Payment Methods
We accept a range of payment methods, such as major credit cards, bank transfers, and verified cheques. Payments are processed using secure and encrypted systems.
5. Cancellation and Refund Policy
5.1 Customer Cancellations
- Over 72 hours before departure: A full refund minus any processing charges
- From 24 to 72 hours before departure: A 50% refund
- Less than 24 hours before departure: No refund provided
5.2 Weather Cancellations
In the case of our captain deeming weather conditions unsafe, we shall propose to:
- Reschedule the charter for the next possible date without incurring additional costs
- Issue a full refund if rescheduling is not an option
5.3 Mechanical Issues
If there is a mechanical failure with the vessel you were assigned, efforts will be made to offer a proper replacement. Should no substitute be available, a complete refund will be provided.
6. Safety and Conduct
6.1 Safety Requirements
Passengers must adhere to the following:
- Obey all commands from the crew
- Wear any safety gear as required
- Inform of any medical conditions that could impact their safety
- Stay within permitted areas on the yacht
6.2 Prohibited Items
Certain items are forbidden aboard the yacht:
- Containers made of glass
- Illegal substances
- Firearms or other weapons
- Excessive quantities of drinks (beyond moderate consumption)
- Pets without prior permission
6.3 Conduct
We expect passengers to behave with respect. Any charter may be concluded prematurely with no refund if passenger conduct endangers safety or mars the experience for others.
7. Liability and Insurance
7.1 Our Liability
Our accountability is confined to the cost paid for your charter. We bear no responsibility for:
- Personal harm arising from passenger negligence
- Theft or destruction of personal belongings
- Any indirect, subsequent, or significant damages
- Delays stemming from weather or events outside our influence
7.2 Insurance Coverage
Obligatory marine insurance is in place for our vessels and operations. Passengers are expected to procure their own travel and personal insurance.
7.3 Assumption of Risk
By engaging in our yacht services, you acknowledge the inherent hazards of maritime activities and accept personal responsibility for your safety and security.
8. Modifications and Itinerary Changes
We reserve the authority to alter itineraries, pathways, or timetables because of weather considerations, safety needs, or operational mandates. We will make efforts to offer an experience of comparable value where possible.
9. Force Majeure
We are exempt from liability for interruptions, deferrals, or changes due to forces outside of our control, such as:
- Intense meteorological conditions
- Calamities caused by nature
- Mandates imposed by the government
- Port shutdowns
- Breakdowns of machinery
10. Privacy and Data Protection
Our handling of your personal information is in strict compliance with our Privacy Policy. Your use of our services implies consent to our collection and use of your data as stipulated in the Privacy Policy.
11. Intellectual Property
All materials on our website, such as written content, imagery, emblems, and symbols, are safeguarded by copyright and trademark laws. Unauthorized reproduction, sharing, or derivative creation is prohibited without our express consent.
